Q: We have a disciplinary procedure in place although it was written about 10 years ago. Do we need a new one?

A: It would certainly be a good idea to have your current procedure reviewed as there was a major review of procedures which resulted in the Employment Act 2008 repealing the disciplinary and grievance procedures that were introduced in 2004 and introduced increased powers for Employment Tribunals to raise awards against employers by up to 25% if they had unreasonably failed to comply with the 2009 Acas Code of Practice.

You run the risk in continuing to use old procedures of not complying with the 2009 Acas Code which could result in the 25% increase being applied.

All employee-related procedures should be reviewed regularly, at least every year, to ensure they remain current and are still working effectively for your business.
