Clarity on Payments to Interns, Work Experience and Placements

The Department for Business, Innovation and Skills (BIS) has published guidance to provide clarity on the national minimum wage for employers who offer work experience, placements and internships.   Guidance is given on the employer’s obligation to pay work experience students and interns at least the national minimum wage and confirms when an individual is entitled to be paid national minimum wage. Entitlement to the national minimum wage depends upon whether or not the individual concerned is contracted as a “worker”. If the individual is classified as a “worker” with no exemption must be paid the national minimum wage as a minimum. The guidance also includes a new worker checklist for employers with helpful examples of case studies to help ensure that those who are entitled to the national minimum wage receive it.
