Bribery Act 2010 Comes Into Force on 1st July 2011

We have been waiting for further guidance on the introduction of the Bribery Act which was originally due to be implemented from April, this year. The joint guidance from the Ministry of Justice, Director of Public Prosecutions and Serious Fraud Office was published on 30th March, 2011 and confirms the Act will come into force on 1st July, 2011 with no grace period. Companies are therefore required to develop compliant procedures in time for their effective implementation prior to that date. All businesses covered by the Act will be required to understand that:
  • It is an offence to bribe or to receive a bribe from anyone, including foreign public officials
  • A bribe includes even the smallest facilitation payment
  • Putting adequate procedures in place is a corporate defence to the offence of failing to prevent bribery
We therefore recommend that all companies carry out a thorough and documented risk assessment and back this up with robust policies and procedures which are supported by the management and known to the entire work force. For further advice, please email
