Acas has produced a new guidance to help employers understand the Default Retirement Age (DRA) changes that take effect from 6th April, 2011. The key things for employers to remember are:
- workers will retire whenever they wish to – enforced retirement will only be possible if the employer can objectively justify it
- employers must avoid discriminating against all workers on the grounds of their age
- this legislation applies to all employers, no matter what size or sector
- these changes will not affect an employee’s state pension age and entitlements which may well be different from the age at which they choose to retire.
