Q: With all this news about new data regulations, can we share our employee data with you as our external HR Consultants?

A: Yes. You should have a Privacy Policy in place informing employees that their personal data is being processed by a third party on your Company’s behalf and that the processing will be done in accordance with the Company’s obligations under the General Data Protection Regulation (GDPR). You must ensure that any third party, for example an external HR consultant or a payroll bureau, has sufficient measures in place to comply with the GDPR regulations to protect your employee data. A contract should be in place between you as the employer and the third party Company detailing the processing and security measures that are in place.
